Four BC residents have won their fight against federal legislation that barred medical marijuana patients from growing their own cannabis.
A Federal Court judge in Vancouver has ruled the legislation that forces patients to buy from licensed producers is arbitrary, too broad and violates their charter rights.
Judge Michael Phelan says the patients who challenged the law passed by the former Conservative government demonstrated that marijuana can be produced safely and with limited risk to public safety.
Bob Erb, a well-known marijuana activist applauds the ruling.
He says the law only forced medical marijuana users to purchase their medicine from the black market.
Erb says he’s looking forward to the Trudeau government’s campaign promise to legalize marijuana.
Under today’s ruling, the federal government has six months to create a new medical marijuana regime.
