MiningWatch Canada and a number of supporters are taking the Mount Polley Mining Corporation and the province to court.
The private prosecution case is over the tailings pond disaster at the Mount Polley mine in August 2014.
Ugo Lapointe is with the group and contends both the province and federal governments should have laid charges against Imperial Metals, which owns the Mount Polley mine.
He says laws exist that allows private citizens to launch criminal cases.
The charges were filed at the Williams Lake provincial court yesterday.
The next step is a process hearing in which the group will present evidence alleging to show the mine and the province failed to implement minimum safeguards leading up to the spill.
