BC has become the first province to pass legislation giving Indigenous people legal jurisdiction over child and family services in their communities.
Through the new Indigenous Self-Government in Child and Family Services Amendment Act, the province aims to keep Indigenous children connected with their families and cultures.
Under the act, the province will provide a pathway for Indigenous peoples to create and implement their own laws over child and family services.
By removing existing barriers and gaps, the Act also allows Indigenous governing bodies to take direct responsibility over child protection, custody, guardianship, and care.
It will also see the province improve consultation and consent-based decision-making when it comes to adoption placements.
In addition, the act creates a new Indigenous child welfare position to provide advice through the Ministry of Children and Family Development.
