A lawsuit seeking to end the exclusion of non-status Indigenous people from post-secondary education benefits has been filed in Federal Court.
Filed by the Congress of Aboriginal Peoples, the suit names the Minister of Indigenous Services and Canada’s Attorney General.
It claims that both violated section 15 of the Charter of Rights and Freedoms by effectively impeding access to post-secondary education.
Prior to the filing of the suit, the CAP says they took numerous avenues to try and inform Indigenous Services Canada of the discrimination.
In 2016, the Supreme Court of Canada ruled that the Federal Government has the same responsibilities for non-status people as those with status.
That decision, also stemming from a CAP-filed suit, found that non-status Indigenous people are far more exposed to discrimination than others.
